Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Eterna IQ LLC ("Eterna IQ," "we," "us," or "our") for use of eternaiq.com and related websites, applications, assessments, and platform features (the "Services").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Eterna IQ is a health technology company. We are not a healthcare provider, health plan, insurer, hospital, medical practice, or pharmacy. We do not provide medical care, diagnosis, treatment, or emergency services.

Clinical services described on the site (including laboratory testing, prescribing, medication dispensing, and medical supervision) are provided solely by independent, licensed clinicians and pharmacies in their professional capacities. Your treating relationship is with those providers, subject to their policies and applicable law.

Information on the Services is for general educational purposes and is not medical advice. Always consult a qualified healthcare professional for personal medical decisions. In an emergency, call 911 or your local emergency number.

You must be at least 18 years old and located in a jurisdiction where the Services are offered to create an account or purchase membership. You represent that information you provide is accurate and that you will keep it current.

Intake questionnaires, health snapshots, and similar tools collect information to help personalize education and route you to appropriate next steps. They are not prescriptions, orders, or guarantees of treatment.

Any therapies, laboratory testing, or supplements made available through the platform may require a valid clinician order where required by law, may not be appropriate for everyone, and may involve risks. Individual results vary.

Eterna IQ membership is a recurring monthly subscription. Membership is $199 per month flat, charged automatically to your payment method until you cancel. There is no minimum term and no cancellation fee. You may cancel at any time from your member portal or by emailing us, and cancellation takes effect at the end of the month already paid for.

The $100 founding deposit is a separate, one-time reservation fee. It holds a founding spot and locks founding pricing while you remain an active member. It is refundable within 14 calendar days and is not applied or credited against membership fees.

Prescription medication is billed by our prescribing and pharmacy partner, who is the merchant of record for those charges, not by Eterna IQ. Your card is saved when you submit a clinical intake and is charged only if a licensed provider approves treatment. If a provider declines, you are not charged. Medication charges are subject to that partner's refund and return policies.

Membership payments are processed by our third-party payment provider. You authorize recurring charges according to the plan you select. Except where expressly stated in writing at checkout, fees are non-refundable once clinical or fulfillment work has begun. Refund windows and billing-error handling are set out in our Refund Policy.

Eterna IQ facilitates access to laboratories, pharmacies, coaching, and telehealth partners. We do not control clinical judgment, prescribing decisions, shipping timelines, or regulatory availability in every state. Partner terms and privacy policies may also apply.

Health coaches are not licensed medical providers. Coaching is education, accountability, and support for carrying out a plan your clinician has already approved. Coaches do not diagnose conditions, do not treat disease, and do not prescribe, adjust, or discontinue any medication.

A coach cannot change your clinical protocol. Questions about your diagnosis, your medication, your dose, or symptoms you are experiencing are for your clinician, and your coach will refer them there. If you believe you have a medical emergency, call 911 or go to the nearest emergency room.

Some therapies discussed on the site may be compounded by state-licensed partner pharmacies, including 503B outsourcing facilities registered with the FDA, when a clinician determines they are appropriate. Compounded drug products are not FDA-approved drug products in the same manner as commercially available FDA-approved drugs unless specifically stated. Eterna IQ does not guarantee specific health outcomes.

The Services, including text, graphics, logos, software, and design, are owned by Eterna IQ or our licensors and protected by intellectual property laws. You receive a limited, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETERNA IQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO ETERNA IQ IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the extent permitted by law.

You agree to defend, indemnify, and hold harmless Eterna IQ and its affiliates from claims arising out of your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your state of residence apply.

Before filing a claim, you agree to contact us at support@eternaiq.com to attempt informal resolution. Any dispute not resolved informally will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, unless applicable law requires otherwise.

We may suspend or terminate access to the Services if you violate these Terms, pose a security risk, or as required by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

We may modify these Terms by posting an updated version on this page. Continued use after the effective date constitutes acceptance. Material changes may be communicated by email or in-product notice where appropriate.
